Can I transfer a retirement annuity to a company pension fund?

Question:

Can you transfer a paid-up retirement annuity with a value above R7 000 to a company pension fund?

Answer:

Kobus,

No, that is not possible. This would effectively allow you to circumvent the rule which prohibits you from accessing your paid-up retirement annuity (above R7 000
in value) before the age of 55. The Income Tax Act bars any fund transfers to a less restrictive retirement fund regime. For the same reason, you can money money from a provident fund (no annuity requirement) to a pension fund (annuity requirement) tax-free, but you cannot move tax-free from a pension fund to a provident fund.
