Do I have a legal claim against my estranged spouse's pension?

Question:

Hi My grandmother waz married to a police man long time ago. And my grandfather left her without divocing her and now he is on pension and we want to know if my grandmother can get her share of money because they are no longer living together

Answer:

Thandiwe,

No, she does not currently have a legal claim against his pension. However, on his passing she could be entitled to receive a spouse's pension and a share of the lump sum payment (if any). However, if he was in a partnership with another women and she depended on him financially, then your grandmother's claim to these benefits may be disputed.
