When can I borrow against my spouse's name?

Question:

I don't work, but my husband is working for 1 company 18 years. He is blacklisted for credit cards due to taking care of my Mom's medical needs. She passed away, so now we are in financial difficulties and he can't get a loan anywhere. I am not blacklisted. Can I make a loan on my name and submitting my husband's bank statements and paysheets.

Answer:

Rika, Unfortunately, we can only answer questions related to pension fund law and retirement investing. But if you are married by antenuptial contract excluding accrual, then you could not borrow against your husband's name, and if you are married in community of property (or with an ANC plus accrual), he would have to co-sign the loan, which would then not be approved if he is black-listed.
